Services and Departments

In order to achieve our mandate Msukaligwa Municipality has departments according to the functions each performs.

Office of the Municipal Manager

The existence of the office of the Municipal Manager derives its mandate from various pieces of legislation including the Municipal Structures Act, Municipal Systems Act and Municipal Finance Management Act.

In terms of section 82 of the Municipal Structures Act, 1998 the Municipal Council must appoint a Municipal Manager who shall be the head of administration and the Accounting Officer of the municipality.

  • Responsibilities and Accountability

    The Municipal Manager as head of administration in line with provision of section 55 of the Municipal Systems Act is subject to the policy directions of the municipal council, responsible and accountable for the:

    • the formation and development of an economical, effective, efficient and accountable administration equipped to carry out the task of implementing the municipality’s integrated development plan, operating in accordance with the municipality’s performance management system and responsive to the needs of the local community to participate in the affairs of the municipality;
    • the management of the municipality’s administration in accordance with Municipal Systems Act and other pieces of legislation applicable to the municipality;
    • the implementation of the municipality’s integrated development plan and the monitoring of progress with implementation of the plan;
    • the management of the provision of services to the local community in a sustainable and equitable manner;
    • manage human resources, that include appointment of staff, training and development, sound labour relations and compliance by the municipality to all applicable human resource prescripts;
    • advising the political structures and political office bearers of the municipality and implementation of council decisions;
    • managing communications between the municipality’s administration and its political structures and political office bearers;
    • facilitating participation by the local community in the affairs of the municipality;
    • the implementation of national and provincial legislation applicable to the municipality; and
    • performance of any other function that may be assigned by the Municipal Council.
  • Purpose and Functions

    The purpose of the Office of the Municipal Manager is “To coordinate and manage the provision of service delivery in accordance with the legislation governing local government.” and the functions are as follows:

    • Manage technical services;
    • Coordinate the provision of community services;
    • Coordinate municipal planning and economic development;
    • Manage financial matters;
    • Manage corporate services;
    • Manage communication, IGR and contact centre services;
    • Render internal audit services;
    • Render risk management services;
    • Manage integrated development plan and organisational performance management system; and
    • Manage and coordinate the provision of municipal services in the service delivery units.
  • DIVISION: COMMUNICATIONS/IGR AND CONTACT CENTRE

    The existence of this component is mandated by various pieces of legislation that include the Municipal Systems Act, Minimum Information Security Standards 1996 and Promotion of Access to Information Act 2002. The Minimum Information Security Standards on communication security makes provision and application of security measures for the protection of classified communication. The Promotion of Access to Information Act 2002 give effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights and to provide for matters connected therewith.

    Section 18 of the Municipal Systems Act mandate the municipality to communicate to its community information concerning the available mechanisms, processes and procedures to encourages and facilitate community participation. The information communicated should include the rights and duties of members of the local community and municipal governance, management and development. Furthermore, the information communicated must take into account the language preferences and usage in the municipality and people with special needs, for example who cannot read, write and those who are deaf.

    The purpose of the component is “To manage communication, IGR and contact centre services” and the functions are as follows:

    • Provide internal and external communication services;
    • Manage website of the municipality and social media;
    • Manage integrated complains management services;
    • Render corporate communications;
    • Render branding, advertising and event services;
    • Render public services transformation programmes; and
    • Coordinate Inter-Governmental Relations.
  • DIVISION: INTERNAL AUDIT

    The component derives its mandate from various pieces of legislation including Constitution of South Africa, Municipal Finance Management Act and King 3 Report. In terms of Section 195 (1) of the Constitution, the public administration must be governed by the democratic values that include an efficient, economic and effective use of resources must be promoted and a high standard of professional ethics must be promoted and maintained. The principles apply to administration in every sphere of government, organs of state, as well as public enterprises. Section 215 (1) of the Constitution states that municipal budgets and budgetary processes must promote transparency, accountability and effective financial management of the economy.

    Section 165 of the Municipal Finance Management compels each municipality to have an internal audit unit. The internal audit unit of a municipality must prepare a risk-based audit plan and an internal audit program for each financial year. According to the King 3 Report (2009) the internal audit will have to make combined assurance work and help organisations realise the benefits of cost optimization, prevention of assurance fatigue and a business partner relationship that adds real value by sifting through the irrelevant and focusing on the critical.

    The purpose of the component is “To render internal audit services” and the functions are as follows:

    • Develop internal three year rolling plan and internal audit programmes;
    • Develop internal audit methodology, charter and applicable policies;
    • Develop and monitor quality assurance improvement programme;
    • Execute audit project as per annual plan and adhoc requests from management and audit Committee;
    • Conduct follow up on findings;
    • Provide advice on internal controls, performance management and risk management; and
    • Provide consulting services.
  • DIVISION: RISK MANAGEMENT SERVICES

    The component derives its mandate from the Public Sector Risk Management Framework 2010 and various pieces of legislation. In terms of section 25 of the Public Sector Risk Management Framework 2010, the primary responsibility of the Chief Risk Officer is to bring to bear his/her specialist expertise to assist the Institution to embed risk management and leverage its benefits to enhance performance. The Framework has been developed in response to the requirements of the Municipal Finance Management Act for Institutions to implement and maintain effective, efficient and transparent systems of risk management and control. The aims of the Framework is to support Institutions to improve and sustain their performance by enhancing their systems of risk management to protect against adverse outcomes and optimise opportunities.

    The purpose of the component is “To render risk management services” and the functions are as follows:

    • Develop risk policies, charters and annual implementation plan;
    • Develop and manage municipal risk registers;
    • Conducting awareness on risk management;
    • Render secretariat services to the Risk Management Committee;
    • Monitor the development and implementation of business continuity Management;
    • Conduct refresher workshop on enterprise risk management to risk champions;
    • Conduct awareness on anti-fraud and corruption;
    • Promote ethics management within the organization;
    • Submit risk management reports to stakeholders; and
    • Participate in the conducting of combine assurance services.
  • DIVISION: IDP AND PERFORMANCE MANAGEMENT

    The existence of this component emanates from various pieces of legislation that include the Municipal Systems Act and Policy Framework for Government-wide Monitoring and Evaluation. The Municipal System Act states that each municipality must establish a performance management system that is commensurate with its resources best suited to its circumstances and inline with priorities, objectives, indicators and targets contained in its Integrated Development Plan (IDP). The IDP of a municipality should reflect the Municipal Councils vision for the long-term development of the municipality with special emphasis on the municipality’s most critical development and internal transformation needs.

    A municipality must in terms of its performance management system and in accordance with any regulations and guidelines that may be prescribed establish a process of regularly reporting to the Council, other political structures, political office bearers and staff of the municipality as well as the public and appropriate organs of state. Monitoring and evaluation processes can assist the public sector in evaluating its performance and identifying the factors that contribute to its service delivery outcomes. Monitoring and evaluation helps to provide an evidence base for public resource allocation decisions and helps identify how challenges should be addressed and successes replicated.

    The purpose of the component is “To manage integrated development plan and organisational performance management system” and the functions are as follows:

    • Monitor and evaluate the implementation of municipal programmes;
    • Manage the performance management system;
    • Render organizational performance management;
    • Monitoring the reporting of the SDBIP;
    • Facilitate the development of integrated development planning;
    • Monitor the Implementation of IDP;
    • Make inputs to policy making bodies;
    • Facilitate the development of service delivery and budget implementation plans;
    • Ensure the SDBIP is aligned with the IDP; and
    • Coordinate compilation of quarterly and annual reporting.
  • DIVISION: PROJECT MANAGEMENT

    The purpose of the component is “To manage municipal infrastructure development programmes” and the functions are as follows:

    • Develop plans for infrastructure programmes;
    • Conduct feasibility study of projects;
    • Develop terms of reference for various infrastructure programmes;
    • Render project management and engineering administration;
    • Manage various information systems for project registration and progress reporting; and
    • Participate in cooperative governance programmes.

Technical Services

The Department of Technical Services is crucial to the achievement of the strategic objective of the municipality, which is to provide sustainable and reliable services to communities. The department is responsible for water supply, sanitation services, municipal roads maintenance, electricity, plant and mechanical services.

  • Purpose and Functions

    The purpose of the Department is “To manage technical services” and the functions are as follows:

    • Render vehicle and plant mechanical services;
    • Manage municipal infrastructure development programmes;
    • Manage roads and storm water services;
    • Manage water and sanitation services; and
    • Render electricity services.
  • DIVISION: MECHANICAL SERVICES

    The purpose of the component is “To render vehicle and plant mechanical services” and the functions are as follows:

    • Manage the repairs and maintenance of municipal vehicles, plant and equipment;
    • Coordinate vehicle recovery and testing;
    • Render transportation of the yellow fleet and equipment; and
    • Render welding services.
  • DIVISION: ROADS AND STORM WATER

    The purpose of the component is “To manage roads and storm water services” and the functions are as follows:

    • Manage the maintenance of municipal roads and storm water services;
    • Manage and ensure roads accessibility;
    • Conduct visual road pavement management system; and
    • Participate in cooperative governance programmes.
  • DIVISION: WATER AND SANITATION

    The municipality is required to provide basic services including free basic water services to all members of the community in line with the provision of Section 27 (1)(b) of the Constitution. Section 27 states that everyone has the right to have access to sufficient food and water.

    The purpose of the component is “To manage water and sanitation” services and the functions are the following:

    • Manage the maintenance of water and sewer reticulation systems;
    • Render waste water and water treatment services;
    • Manage and monitor water quality;
    • Manage the distribution of water through carting services;
    • Render boreholes maintenance services; and
    • Report performance on the water and sanitation provision to the national and provincial departments.
  • DIVISION: ELECTRICITY SERVICES

    The purpose of the component is “To render electrical services” and the functions are as follows:

    • Develop plans for electricity provisioning and infrastructure maintenance;
    • Manage network and electrical infrastructure;
    • Render meter installation and repairs services;
    • Render electro-mechanical engineering services;
    • Engage with NERSA to sustain distribution license; and
    • Participate in cooperative governance programmes.

Financial Services

The existence of this department is mandated by chapter 9 of Municipal Finance Management Act, 2003 (Act No. 56 of 2003). Section 80 of the Municipal Finance Management Act mandate the establishment of Budget and Treasury Office and makes provision for the Accounting Officer to designate the position of Chief Financial Officer (CFO) of the local municipality. 

  • Role of the Chief Financial Officer

    The role of the Chief Financial Officer of a municipality is to:

    • Advise the Accounting Officer on the exercise of powers and duties assigned to the Accounting Officer in terms of this Act;
    • Assist the Accounting Officer in the administration of the municipality's bank accounts and in the preparation and implementation of the municipality's budget;
    • Must advise senior managers and other senior officials in the exercise of powers and duties on financial management matters; and
    • Perform budgeting, accounting analysis, financial reporting, cash management, debt management, supply chain management, financial management, review and other duties as delegated by the Accounting Officer to the Chief Financial Officer.
  • Purpose and Functions

    The purpose of this component is “To manage financial matters” and the functions are as follows:

    • Manage municipal budget and financial reporting;
    • Manage municipal assets, insurance and fleet management services;
    • Manage expenditure services;
    • Render supply chain management services; and
    • Render revenue, credit control and cash management services.
  • DIVISION: BUDGET AND FINANCIAL REPORTING

    The existence of this component emanates from various pieces of legislation including the Municipal Finance Management Act (MFMA) and Constitution of South Africa. In terms of section 64 of the MFMA, the Accounting Officer must take all reasonable steps to ensure that:

    • The municipality has effective revenue collection systems consistent with section 95 of the Municipal Systems Act and the municipality’s credit and debt collection policy;
    • That revenue due to the municipality is calculated on a monthly basis;
    • That accounts for municipal tax and charges for municipal services are prepared on a monthly basis or less often as may be prescribed where monthly accounts are uneconomical;
    • All money received is promptly deposited into the municipality’s primary and other bank accounts; and
    • The municipality has and maintains a system of internal control in respect of debtors and revenue.

    Section 215 (3) of the Constitution states that the budget in each sphere of government must contain the following:

    • Estimates of revenue and expenditure, differentiating between capital and current expenditure;
    • Proposals for financing any anticipated deficit for the period to which they apply; and
    • An indication of intention regarding borrowing and other forms of public and liability that will increase public debt during the ensuing year.

    The purpose of this component is “To manage municipal budget and financial reporting.” and the functions are as follows:

    • Compile budget estimates;
    • Align budget with the integrated development plan of the municipality;
    • Establish and maintain an accounting database;
    • Monitor and provide advice on budget spending;
    • Render budget and financial reporting;
    • Manage the financial system; and
    • Render bank reconciliation.
  • DIVISION: ASSET MANAGEMENT

    The component is mandated by various pieces of legislation including the Municipal Finance Management Act. Section 63 of the MFMA states that the accounting must take all reasonable steps to ensure that:

    • The municipality has and maintains a management, accounting and information system that accounts for the assets and liabilities of the municipality;
    • The municipality’s assets and liabilities are valued in accordance with standards of generally recognised accounting practice; and
    • The municipality has and maintains a system of internal control of assets and liabilities, including an asset and liabilities register

    The purpose of this component is “To manage municipal assets, insurance and fleet management services.” and the functions are as follows:

    • Coordinate movable and immovable assets;
    • Develop asset management plan;
    • Conduct physical verification of assets;
    • Identify assets for disposal and manage disposal process;
    • Facilitate the safeguarding of assets;

  • DIVISION: EXPENDITURE MANAGEMENT

    The existence of this component is mandated by the provision of the Municipal Finance Management Act. Section 65 of the MFMA state that the Accounting Officer must take all reasonable steps to ensure that:

    • The municipality has and maintains an effective system of expenditure control, including procedures for the approval, authorization, withdrawal and payment of funds;
    • The municipality has and maintains a system of internal control in respect of creditors and payments;
    • All money owing by the municipality be paid within 30 days of receiving the relevant invoice or statement, unless prescribed otherwise for certain categories of expenditure;
    • The municipality's available working capital is managed effectively and economically in terms of the prescribed cash management and investment framework;
    • The municipality complies with its tax, levy, duty, pension, medical aid, audit fees and other statutory commitments; and
    • All financial accounts of the municipality are closed at the end of each month and reconciled with its records.

    The purpose of this component is “To manage expenditure services” and the functions are as follows:

    • Manage the payments of goods and services;
    • Reconcile creditors’ accounts;
    • Compile expenditure control reports; and
    • Manage the payment of salaries.
  • DIVISION: SUPPLY CHAIN MANAGEMENT

    The existence of this component is mandated by various pieces of legislations including the Municipal Finance Management Act, Constitution of South Africa and Supply Chain Management Regulations. Section 111 of the Municipal Finance Management Act compels each municipality to develop and implement a Supply Chain Management Policy. The Supply Chain Management Policy of a municipality must be fair, equitable, transparent, competitive and cost-effective and comply with a prescribed regulatory framework for municipal supply chain management in section 112(1) of the MFMA.

    The Council in compliance with Regulations 4 of the Municipal Supply Chain Management Regulations must delegate the powers and duties of the supply chain management policy to the Accounting Officer. The delegation will enable the Accounting Officer to enforce reasonable cost-effective measures for the prevention of fraud, corruption, favouritism and unfair and irregular practices in the implementation of the supply chain management policy.

    Section 217 (1) of the Constitution of the Republic of South Africa states that when an organ of state in the national, provincial or local sphere of government or any other institution identified in national legislation contracts for goods or services it must do so in accordance with a system which is fair, equitable, transparent, competitive and cost-effective.

    The purpose of this component is “To render supply chain management services.” and the functions are as follows:

    • Manage acquisition and demand planning services;
    • Render supply chain performance management services;
    • Administer database of suppliers;
    • Render logistics management services;
    • Render secretariat services for bid committees; and
    • Render contract management.
  • DIVISION: REVENUE, CREDIT CONTROL AND CASH MANAGEMENT

    The existence of this component is mandated by various pieces of legislations including the Municipal Finance Management Act. In terms of the requirements of Section 64 of the MFMA, the must take all reasonable steps to ensure that:

    • The municipality has effective revenue collection systems consistent with section 95 of the Municipal Systems Act and the municipality’s credit control and debt collection policy;
    • that revenue due to the municipality is calculated on a monthly basis;
    • that accounts for municipal tax and charges for municipal services are prepared on a monthly basis, or less often as may be prescribed where monthly accounts are uneconomical;
    • all money received is promptly deposited into the municipality’s primary and other bank accounts;
    • The municipality has and maintains a system of internal control in respect of debtors and revenue;
    • Revenue collected is reconciled at least weekly;
    • the municipality has and maintains a management, accounting and information system which recognizes revenue when it is earned, accounts for debtors and accounts for receipts of revenue.

    The purpose of this component is “To render revenue, credit control and cash management services” and the functions are as follows:

    • Process payment arrangement;
    • Render revenue and debt collection services;
    • Follow up on outstanding debt;
    • Render cashier services and banking;
    • Render meter reading services;
    • Manage property rates and valuation roll;
    • Issue rate clearance certificates;
    • Generate sundry income; and
    • Manage register of households indigent.

Community & Social Services

The creation of the component is mandated by pieces of legislation that include the Constitution of the of South Africa, 1996. Schedule 4 part B of the Constitution makes provisions for administering air pollution, building regulations, childcare facilities, firefighting services, municipal airports, municipal planning, municipal health services, municipal public transport and municipal public works. Section 24 of the Constitution of South Africa together with schedule 5 part B states that, everyone has the right to an environment that is not harmful to their health or well-being and to have the environment protected for the benefit of present and future generations. This should be done through reasonable legislative and other measures that prevent pollution and ecological degradation, promote conservation and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.

Schedule 5B gives mandate to the local municipality to administer billboards and the display of advertisements, cemeteries, funeral parlours and crematoria, cleansing, control of public nuisances, selling of liquor to the public, local amenities, local sport facilities, markets, municipal parks and recreation, noise pollution, refuse removal, refuse dumps and solid waste disposal, street trading, street lighting traffic and parking.

  • Purpose and Functions

    The purpose of the Department is “To coordinate the provision of community services” and the functions are as follows:

    • Render disaster, security management and law enforcement services;
    • Coordinate waste management and environmental services;
    • Coordinate the maintenance of parks, sports and cemeteries;
    • Render traffic management services;
    • Render fire management services;
    • Manage the provision of drivers and motor vehicle registration and licensing services; and
    • Render library and information services.

    The Department is divided into seven divisions, i.e. Disaster, Security Management and Law Enforcement, Waste Management and Environmental Services, Parks, Sports and Cemeteries, Traffic Services, Fire Services, and Library Services.

  • DIVISION: DISASTER, SECURITY MANAGEMENT AND LAW ENFORCEMENT

    The existence of this component derives its mandate from various pieces of legislation that include the Minimum Information Security Standards and Disaster Management Act. In line with Section 53 of the Disaster Management Act 93 of 1996, the municipality must within the applicable municipal disaster management framework prepare a disaster management plan that respond or addresses prevailing circumstances, co-ordinate and align the implementation of its plan with those of other organs of state and institutional role-players, regularly review and update its plan.

    According to the Minimum Information Security Standards (Chapter 3) approved on 4 December 1996 by Cabinet as a National Information Security Policy, the head of every institution bears overall responsibility for the provision and maintenance of security in his/her institution, under all circumstances. Apart from the ordinary or customary powers of delegation to senior officers or employees, it is necessary to prepare a clearly formulated policy signed by the head of the institution with regard to security in order to maintain information security and to ensure physical security.

    The primary mandate of the unit is to combat crime, enforcement of Municipal by-laws and addressing truck related problems in Msukaligwa municipality.

    The purpose of the component is “To render disaster, security management and law enforcement services” and the functions are as follows:

    • Coordinate disaster management services;
    • Develop and review risk reduction strategies;
    • Coordinate the provision of security services; and
    • Ensure compliance of gazzeted municipal by-laws.
  • DIVISION: WASTE MANAGEMENT AND ENVIRONMENTAL SERVICES

    The component derives its mandate from National Environmental Management: Waste Management Act, 2008. In terms of Section 24 of the Act, local municipalities must implement its waste management operations in a manner that the disposal systems comply with all legislative standards. The Act direct municipalities to focus on the objectives that provide an efficient waste removal services, minimize waste through recycling, increase the lifespan of the landfill site and provide an environment not detrimental to the health, mental and physical wellbeing of the community.

    According to the preamble of the Environmental Act, everyone has the right to have the environment protected for the benefit of present and future generations through reasonable legislative and other measures that prevent pollution and ecological degradation and promote conservation. The functional area of environment is concurrent to national and provincial legislative competence, and all spheres of government and all organs of state must co-operate with, consult and support one another. The increase in the waste and refuse within the local municipality as identified in the IDP necessitated the creation of additional posts such as general workers in the revised organisational structure to address the challenge.

    The purpose of the component is “To coordinate waste management and environmental services” and the functions are as follows:

    • Manage refuse removal services;
    • Manage streets and public open space cleaning services;
    • Monitor and remove illegal dumping;
    • Conduct waste management and environmental campaigns to the community;
    • Monitor compliance to waste management Act and other related prescripts;
    • Manage operation and maintenance of landfill sites and transfer stations;
    • Establish waste minimization and recycling facilities;
    • Develop and manage integrated waste management plans; and
    • Render environmental pollution control.
  • DIVISION: PARKS, SPORTS AND CEMETERIES

    The existence of this division emanates from section 24 of the Constitution of South Africa which states that, everyone has the right to an environment that is not harmful to their health or well-being and to have the environment protected, for the benefit of present and future generations. Through reasonable legislative and other measures that prevent pollution and ecological degradation, promote conservation and secure ecologically sustainable development and use of natural resources while promoting justifiable economic and social development.

    The purpose of the component is “To coordinate the maintenance of parks, sports and cemeteries” and the functions are as follows:

    • Manage parks and cemetery services;
    • Develop and maintain parks and public open space;
    • Manage the maintenance of existing and closed cemeteries;
    • Conduct grass cutting, tree pruning and landscaping;
    • Manage the control of invasive plants/trees;
    • Manage pest control services; and
    • Manage sports facilities.
  • DIVISION: TRAFFIC SERVICES

    The mandate of the component is emanates from various pieces of legislation that include the National Road Traffic Act, 1996, The National Road Traffic Act provides for road traffic matters which shall apply uniformly throughout South Africa. The purpose is “To render traffic management services” and the functions are as follows:

    • Conduct law enforcement services;
    • Render school patrol services;
    • Provide escort services (special event and funerals); and
    • Conduct point duty services.
  • DIVISION: FIRE SERVICES

    The existence of this division derives its mandate from various pieces of legislation that include the Disaster Management Act 93 of 1996. Sections 53 of the Disaster Management Act 93, states that the municipality must within the applicable municipal disaster management framework prepare a disaster management plan that respond or addresses prevailing circumstances, co-ordinate and align the implementation of its plan with those of other organs of state and institutional role-players, regularly review and update its plan.

    The purpose is “To render fire management services” and the functions are as follows:

    • Provide fire and rescue services;
    • Develop and implement fire prevention plans;
    • Conduct fire awareness campaigns to the business and communities;
    • Ensure compliance to fire prevention prescripts of buildings and storage of flammable liquids registration;
    • Conduct fire risk assessment; and
    • Facilitate the issuing of permits to flammable transport.
  • DIVISION: LIBRARY SERVICES

    The existence of this division derives its mandate from various pieces of legislation that include the Constitution of South, 1996 and the Promotion of Access to Information Act 2002. Chapter 2 of the Constitution states that everyone has the right to access to information. The Promotion of Access to Information Act 2002 gives effect to the constitutional right of access to any information held by the State and any information that is held by another person and that is required for the exercise or protection of any rights and to provide for matters connected therewith.

    The purpose of the component is “To render library and information services” and the functions are as follows:

    • Manage the marketing delivery and information services;
    • Provide internet services to the community;
    • Conduct weeding of books and repairs of all books;
    • Provide library information to the general public; and
    • Evaluate library material.

Planning & Economic Development

The existence of this department is mandated by various pieces of legislation that includes the Municipal Staff Regulations promulgated September 2021, Spatial Planning Land Use Management Act, 2013 and the Property Rates Act, 2004. In terms of Regulation 5 of the Municipal Staff Regulations, a municipality may within its administrative and financial capacity establish separate departments, including the department for Development and Town Planning, amongst others. Section 21 of the Spatial Planning and Land Use Management Act compels each Municipal Council to adopt a municipal spatial development framework and the framework must:

  • Include a written and spatial representation of a five-year spatial development for spatial form of the municipality;
  • Include long term spatial development vision statement which indicates a desired spatial growth and development pattern for the next 10 to 20 years;
  • Include estimates of the demand for housing units across different socio-economic categories and the panned location and density of future housing development;
  • Identify current and future significant structuring and restructuring elements of the spatial form of municipality, including development corridors, activity spines and economic nodes where public and private investment will be prioritized and facilitated; and
  • Identify, quantify and provide location requirements of engineering infrastructure and service provisions for existing and future development needs.

Property Rates Act regulates the power of a municipality to impose rates on property and to certain properties from rating in the national interest.

  • Purpose and Functions

    The purpose of the component is “To coordinate municipal planning and economic development” and the functions are as follows:

    • Render spatial planning and land use management services;
    • Render sustainable and integrated human settlements planning and property management; and
    • Promote local economic development services.
  • DIVISION: LAND USE AND SPATIAL DEVELOPMENT

    The existence of this component is mandated by the Spatial Planning Land Use Management Act, 2013. In line with Section 21 of the Spatial Planning and Land Use Management Act, each municipal Council is required to adopt municipal spatial development framework. A Municipal spatial development framework is regarded as a mechanism to direct future growth and achieve the desired spatial form of the municipality, which seeks to guide the overall spatial distribution of current and desirable future land uses within a municipality in order to give effect to the vision, goals and objectives of the municipal IDP.

    It was noted through the IDP that the local municipality reviewed its spatial development framework in 2020. The aim of the spatial development framework is to promote sustainable functional and integrated human settlements, maximize resource efficiency, and enhance regional identity and unique character of a place. According to the IDP of the municipality, the objective of the division is to provide a visual representation of the desired spatial form of the municipality, which representation will:

    • indicate where public and private land development and infrastructure investment should take place;
    • indicate desired or undesired utilization of space in a particular area;
    • delineate the urban area within a well-defined urban edge;
    • identify areas where strategic intervention is required; and
    • Indicate areas where priority spending is required.

    The purpose of the component is “To render land use and spatial management services.” and the functions are as follows:

    • Manage building control regulations;
    • Manage geographic information systems;
    • Render land surveying services;
    • Render land management services;
    • Management of outdoor advertising;
    • Manage spatial planning; and
    • Develop and manage the implementation of the strategic planning documents.
  • DIVISION: HUMAN SETTLEMENTS AND PROPERTY MANAGEMENT

    The mandate of the Division: Human Settlements is derived from various pieces of legislation including the Constitution of South Africa and the Property Rates Act. The Property Rates Act No. 6 of 2004 regulates the power of a municipality to impose rates on property and to exclude certain properties from rating in the national interest. The Constitution of South Africa Act, 106 of 1996 section 26, states that:

    • Everyone has the right to have access to adequate housing;
    • The state must take reasonable legislative and other measures, within its available resources, to achieve the progressive realization of this right; and
    • No one may be evicted from their home, or have their home demolished without an order of court made after considering all relevant circumstances. No legislation may permit arbitrary evictions.

    The purpose of this component is “To render sustainable and integrated human settlements planning and property management” and the functions are as follows:

    • Facilitate the identification and registration of potential beneficiaries;
    • Conduct consumer education services;
    • Develop and maintain database of informal settlements;
    • Render human settlement planning;
    • Manage the rendering of rental housing stock;
    • Manage and monitor housing projects;
    • Render property management services; and
    • Manage property lease agreements.
  • DIVISION: LOCAL ECONOMIC DEVELOPMENT

    The strategic objective of the local economic development component as per the IDP of the municipality is to coordinate efforts to address unemployment and poverty. The officials of the component are expected to identify and create an enabling environment for business opportunities and investments in the local municipality. The main strategic focus will be on job creation, promoting and support of Small Medium and Micro Enterprises, sustaining of existing business, promotion of tourism, increasing local beneficiation and shared growth. The economy of Msukaligwa Municipality is predominantly based on coal mining, agriculture, forestry and timber processing. The municipality is also hosting Eskom’s Camden power station, which is being fed by surrounding coal mine stretching from Chief Albert Luthuli Municipality. Coal transportation is also contributing a lot in terms of employment and support of local businesses.

    The purpose of this component is “To promote local economic development services” and the functions are as follows:

    • Facilitate the development and review of the municipal Local Economic strategic plans;
    • Monitor the implementation of LED programmes and evaluate the impact thereof;
    • Mobilise and coordinate public/private sector support to municipal LED programmes;
    • Identify and market new economic opportunities;
    • Promote tourism and other economic sectors within the local municipality;
    • Manage the registration of formal and informal business;
    • Monitor compliance to business specification and utilisation;
    • Connect businesses with funding institution; and
    • Facilitate and coordinate the development and implementation of Social Labour and Corporate Social Investment Programmes and projects.

Corporate Services

The Department of Corporate Services pivotal in the support of all municipal functions. This department is mandated by various pieces of legislation including the Constitution. Section 195 (i) of the Constitution states that public administration must be broadly representative of the South African people with employment and personnel management practices based on ability, objectivity, fairness and the need to redress the imbalances of the past to achieve broad representation. Public administration must be governed by the democratic values and principles of good human resource management and career-development practices to maximise human potential.

  • Purpose and Functions

    The purpose of this department is “To manage corporate services” and the functions are as follows:

    • Render human resource management and development services;
    • Render legal services;
    • Render secretariat and records management services;
    • Manage information and communication technology services;
    • Provide maintenance to municipal buildings;
  • DIVISION: HUMAN RESOURCE MANAGEMENT AND DEVELOPMENT

    The existence of this component is mandated by various pieces of legislations including the Municipal staff Regulations, 2021. Regulation 4 of the Municipal staff Regulations states that the municipal council must plan for the recruitment, retention and development of staff members according to the requirements of the municipality within the available budgeted funds.

    The purpose of this component is “To render human resource management and development services” and the functions are as follows:

    • Render human resource recruitment, selection and benefits/ conditions of service;
    • Manage human resource planning;
    • Manage human resource development and employee performance management services;
    • Render occupational health and safety services;
    • Administer human resource management system;
    • Coordinate employee health and wellness;
    • Render organisational development and facilitate job evaluation; and
    • Render labour relations services
  • DIVISION: LEGAL SERVICES

    The purpose of the component is “To render legal services” and the functions are as follows:

    • Liaise with the State Attorneys and State Law Advisors;
    • Draft municipal contracts and SLAs;
    • Provide legal advice to management and Council; and
    • Represent Council on litigation matters.
  • DIVISION: COUNCIL SECRETARIAT AND RECORDS MANAGEMENT

    The existence of this component is mandated by various pieces of legislations including the Municipal System Act, 1998 and the National Archives and Records Service of South Africa Act. Sections 79 and 80 of the Municipal System Act state that a Municipal Council may establish one or more committees necessary for the effective and efficient performance of any of its functions or the exercise of any of its powers.

    In terms the Section 13(5) of the National Archives and Records Service of South Africa Act (Act 43 of 1996) the head of a governmental body shall, subject to any law governing the employment of personnel of the governmental body concerned and such requirements as may be prescribed, designate an official of the body to be the records manager of the body. The Records Manager shall be responsible to see to it that the municipality complies with the requirements of this Act.

    The purpose of the component is “To render secretariat and record management services” and the functions are as follows:

    • Render secretariat services to Council and Council Committees;
    • Prepare reports to the Council and its committees;
    • Manage council resolutions;
    • Compile agendas for council committees;
    • Render records management services;
    • Render administrative support to the municipal public account committee (MPAC); and
    • Render driving and messaging services.
  • DIVISION: INFORMATION AND COMMUNICATION TECHNOLOGY

    The Information and Communication Technology (ICT) component is crucial to the migration towards the Forth Industrial Revolution (4IR) as encouraged by the President on his latest state of the nation address.

    The purpose of the component is “To manage information and communication technology services” and the functions are as follows:

    • Manage the municipal ICT operations;
    • Ensure the implementation of ICT disaster recovery;
    • Manage the provision and support services of information technology;
    • Render network support services; and
    • Provide e-governance systems.
  • DIVISION: FACILITY MANAGEMENT AND AUXILLARY SERVICES

    The purpose of the component is “To provide maintenance to municipal buildings” and the functions are as follows:

    • Manage cleaning service of municipal buildings;
    • Manage the provision of minor repairs; and
    • Render caretaking and hiring of municipal community halls.
